(AP) ? The Supreme Court decided Friday not to consider reinstating the government's $550,000 fine on CBS for Janet Jackson's infamous breast-bearing "wardrobe malfunction" at the 2004 Super Bowl.

The high court refused to hear an appeal from the Federal Communications Commission over the penalty.

The 3rd U.S. Circuit Court of Appeals twice had thrown out the fine. The second time came after the Supreme Court upheld the FCC's policy threatening fines against even one-time uses of curse words on live television.

The appeals court said FCC's policy of excusing fleeting instances of indecent words and images appeared to change without notice in March 2004, a month after Jackson's halftime act. The judges said that made the agency's action against CBS "arbitrary and capricious."

But now, the FCC clearly has abandoned its exception for fleeting expletives, Chief Justice John Roberts said.

"It is now clear that the brevity of an indecent broadcast ? be it word or image ? cannot immunize it from FCC censure," he said. "Any future 'wardrobe malfunctions' will not be protected on the ground relied on by the court below."

As an Apple product-lovin' enthusiast, my default gut reaction is to defend Apple, just like my gut reaction to defend my family and friends. When Apple does something silly, or more likely doesn't do something it ought to do -- or consumers wish it would do -- I tend to think about it from the perspective of Apple's business interests. And I rationalize it.

Apple wins preliminary U.S. sales injunction of Samsung Galaxy Tab 10.1

California judge Lucy Koh has ruled in favor of a preliminary injunction against the Galaxy Tab 10.1 requested by Apple, which will result in a halt of sales in the U.S. once Apple posts a $2.6 billion bond to cover potential damages Samsung would suffer. "Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products," Judge Koh said.

Sex Ed Transforms: Transformative Sex Ed in Action: The Ethical ...

The Sex Ed Team at the Moishe Kavod House in Brookline, MA had our first ever (first annual?) team retreat ten day ago. We wanted to spend a whole day talking together about sex, sexuality, and relationships in our lives and in our communities so that we could create a safe space in which to really dive into the trickier, stickier, more complex questions that came up during our workshops this past year.

We had 18 people in attendance, including people who had been integrally involved in the team for the past year or more as well as people for whom the retreat was their first team event. Many people wanted to join us but couldn?t make it, so I thought I?d provide here a little taste of the questions we asked each other:

*How does your Judaism [religion, spirituality] impact your sexuality? How does your sexuality impact your Judaism [religion, spirituality]?

*What happens when I don?t fit into the question you?re asking?

*What are the two most salient pieces of your identity? How do these identities make you feel powerful, powerless, or both at different times throughout your life?

*Do your sexual ethics change in different relationships?

*What personal needs does sex ed meet for you? What personal needs could sex ed meet for you in the future?

*How can we broaden and deepen our impact on the world through sex ed?

We also had three small groups break out for an hour in the afternoon. Their discussions focused on three different themes: jealousy, asexuality, and body image.

By the end of the day, I could feel that the people in the room were very excited and ready to take on leadership of the team in the coming year and get some great work done. We want to do a thorough revision of our six-part curriculum, paying special attention to issues of power, privilege, and identity in framing the activities and informing the discussions, as well as working to integrate Judaism and Jewish learning in a variety of ways. We will also continue to make space for structured and unstructured conversations in our community about relevant topics related to sex, sexuality, and relationships. In addition, we will explore the process of building power so that we can engage in outreach work, take action, and have an impact on the world at large.

If you want to hear more about our work or maybe get involved, feel free to contact me directly or email our team leaders at EthicalSexuality (at) kavodhouse (dot) com.

Supreme Court strikes down Montana law, reaffirming Citizens United

Voting 5 to 4, the justices found, in a two-paragraph opinion, that the Supreme Court's Citizens United ruling applied to a 100-year-old Montana anticorruption law barring corporate money in elections.

By Warren Richey,?Staff writer / June 25, 2012

In a reaffirmation of its controversial Citizens United decision on campaign finances, the US Supreme Court on Monday struck down as unconstitutional a 100-year old Montana law that banned corporations from spending money to influence state elections.

The high court voted 5 to 4 to summarily reverse a December 2011 decision by the Montana Supreme Court upholding the state?s Corrupt Practices Act of 1912.

The 1912 ban on corporate money in elections was passed to prevent a return of the widespread corruption of the ?Copper Kings,? when wealthy and powerful mining interests in Montana routinely bought judges, controlled newspapers, and bribed lawmakers.

The majority justices dismissed the Montana high court?s decision in a two-paragraph opinion.

?The question presented in this case is whether the holding of Citizens United applies to the Montana state law,? the unsigned opinion said. ?There can be no serious doubt that it does.?

In its 2010 decision, Citizens United v. Federal Election Commission, the high court ruled that a federal ban on independent expenditures prior to an election violated the First Amendment rights of corporations and labor unions to engage in political speech free of government censorship.

?Political speech does not lose its First Amendment protection simply because its source is a corporation,? the court held.

The Montana high court ruled that the Citizens United decision did not apply in their state because Montana had a long history of election-related corruption that justified restrictions on corporate spending even a century later.

Justice Stephen Breyer said in a dissent that he would have voted to hear the Montana case and use the case as a vehicle to reconsider the underlying decision in Citizens United, but it was clear there were not enough votes to do that. Three other justices joined Breyer?s dissent; Ruth Bader Ginsburg, Sonia Sotomayor, and Elena Kagan.

?This court?s legal conclusions should not bar the Montana Supreme Court?s finding, made on the record before it, that independent expenditures by corporations did in fact lead to corruption or the appearance of corruption in Montana,? Breyer said.

?Given the history and political landscape in Montana, that court concluded that the state had a compelling interest in limiting independent expenditures by corporations,? he wrote.

?Montana?s experience, like considerable experience elsewhere since the court?s decision in Citizens United, casts grave doubt on the court?s supposition that independent expenditures do not corrupt or appear to do so.?

The high court reversal brought praise from free speech advocates and disappointment from supporters of campaign finance reform efforts.

?The Supreme Court is broken,? said Russ Feingold, a former US senator from Wisconsin Senator and a champion of campaign finance reform. ?The Supreme Court had a perfect chance today to clean up the corrupt mess created by their lawless Citizens United decision. Instead, they just shrugged.?

Senate Republican leader Mitch McConnell called the Supreme Court?s summary reversal ?another important victory for freedom of speech.?

How Animals Can Help With Senior Care

When it comes to senior care, animal therapy can provide significant benefits that few types of medical or other therapeutic strategies can rival. However, a large amount of the recorded improvements observed during interactions between seniors and animals remain unexplained. Nevertheless, it's not something that needs explaining; for many people, animal therapy just works, and it might work for your elderly family members as well. The following are 5 ways that pet therapy for seniors can improve their quality of life.

1.) Companionship

One of the biggest difficulties facing the elderly is loneliness. In fact, many people believe that because humans are such highly social creatures, loneliness can actually lead to a decline in emotional and physical health. Animal companionship fills this empty gap in a senior's life. If cared for properly, animals can provide constant companionship, affection, and in some cases even improve mobility issues by helping a person stay active.

2.) Keep Busy/Distraction

Elderly people with dementia or chronic pain can benefit from animal therapy because the interaction with a pet can help to distract them from their discomfort and focus their mind on other things. Animals provide plenty of reason to do more than just watch television, stare out the window or sleep. In fact, because animals are sometimes known to be able to sense emotional upset or physical discomfort, they may actively seek to engage their owners when they sense this, providing reassurance and a warm, welcome distraction.

3.) Healthy Routines

As we age the routines that we keep tend to change. With kids no longer in the home and in some cases no spouse or other family to care for, the elderly sometimes stop following any routine at all -- an unhealthy choice as the mind and body need to stay active in order to maintain their functions.

Like humans, animals also function well with a routine. They need to be taken out to relieve themselves, fed, groomed and interacted with on a regular, several-times-a-day basis. When an elderly person has a pet, they often find it much easier to maintain a routine because they MUST do so in order to care for their animals.

The need to care for other living beings is a critical human need, so a pet-related routine shouldn't be looked at as a hindrance or bother -- it could prove extremely beneficial because it will allow the pet owner to have something to care about/for again, giving new meaning to their life.

4.) Emotional & Physical Connection

A common problem with many seniors is withdrawal from relationships and social interaction; especially when dementia is present. Having an animal or taking part in pet therapy can help to mitigate this serious concern, as seniors often take readily to animals whereas they may withdraw even from people they have known their entire lives. Having emotional connections is critical for sound mental health.

Additionally, just the act of petting or playing with a pet can provide that critical need that all humans have for physical affection with a being that they care about.

5.) Longer Life

Many studies and a great deal of anecdotal evidence suggest that people who have pets live longer. This seems to be especially true in the case of elderly people, as keeping a routine, having companionship and an emotional connection with an animal can help to improve their physical health. And if their health improves, then it's likely that they'll live longer, better-quality lives.

Big-bang soup snags world record for hotness

A video from Brookhaven Lab explains why the Relativistic Heavy Ion Collider, or RHIC, is producing temperatures up to 4 trillion degrees Celsius.

By Alan Boyle

What's hotter than Justin Bieber and Emma Stone put together? Guinness World Records says the hottest stuff made by humans is the multitrillion-degree quark-gluon plasma that was produced two years ago at the Brookhaven National Laboratory's Relativistic Heavy Ion Collider, or RHIC. The plasma, also known as big-bang soup, reached a temperature of 4 trillion degrees Celsius (7.2 trillion degrees Fahrenheit), which is 250,000 times hotter than the center of the sun.

Why so hot? RHIC's physicists were seeking to duplicate the conditions that existed just an instant after the big bang that kicked off the universe's expansion 13.7 billion years ago. At that temperature, the quarks and gluons that are almost always bound together in protons, neutrons and the like are jumping around in a free, soupy state. Studying that soup could reveal how the universe is put together at its most fundamental level.

The RHIC team created the soup by accelerating gold ions in a 2.4-mile-round magnetic ring in New York, and smashing them together at nearly the speed of light. They found that the proton-sized dollops of plasma had the characteristics of a nearly perfect liquid rather than a gas.

"There are many cool things about this ultra-hot matter,? Steven Vigdor, who leads Brookhaven?s nuclear and particle physics program, said in today's news release about the Guinness recognition. "We expected to reach these temperatures ?that is, after all, why RHIC was built ? but we did not at all anticipate the nearly perfect liquid behavior."

Vigdor noted that trapped atom samples also behave much like a liquid on the other end of the temperature spectrum, near absolute zero. "The unity of physics is a beautiful thing!" he said.

Like an aging celebrity, the 12-year-old RHIC is slowly being eclipsed by the new kid on the block ??CERN's Large Hadron Collider on the French-Swiss border, which is in its fourth year of operation. One of the detectors at the LHC, known as ALICE ("A Large Ion Collider Experiment"), is doing similar big-bang experiments with lead ions, and has achieved temperatures higher than RHIC's.?Some researchers have estimated that ALICE's soup gets as hot as?10 trillion degrees.?

"The energy density at the LHC is a factor of three higher than at RHIC," Brookhaven quotes CERN physicist Despina Hatzifotiadou as saying. "This translates to a 30 percent increase in absolute temperature compared to the value achieved by RHIC. So I would say that ALICE has the record!"

The only holdup is that ALICE's team has not yet published an official temperature measurement for its quark-gluon plasma, and as Brookhaven notes, "the Guinness team is nothing if not official." That means there's still plenty of time to raise a pint of Guinness (or your favorite alternate beverage) and drink a toast to RHIC's hotness.

Berkeley Study: For MBAs, Happiness Isn?t About the Money

200px-Album_no_respect"Well after the point that Facebook's valuation passed $1B, Mark still lived in a small, crappy apartment and slept on a mattress on the floor. All he really cared about was work and he spent most of his waking hours at the office," wrote?Facebook's first product manager, Ezra Callahan. Entrepreneurs have a peculiar habit of bucking the capitalistic expectation of easy money for long hours hunched over a laptop, leaving cushy jobs to start a risky new company, dedicating their time to charity, or simply working enough hours to make their equivalent hourly salary less-than-minimum-wage. A new longitudinal study of business students has an explanation: happiness isn't about the money.

Mayor Cory Booker is at it again ? sort of.

Two months after he shot to national prominence for rescuing neighbors from a fire, the Newark, N.J. mayor showed up at the scene of a car accident where a pedestrian had just been hit ? but it was someone else who did most of the heroics.

?God bless my residents. Pulled up on pedestrian/vehicle accident. We got man stabilized & into ambulance. He?ll b OK. Thanx 2 all who helped,? Booker tweeted Friday afternoon.

Booker told WNBC-TV he helped get water and ice for the victim and comforted the man until an ambulance arrived.

He followed up with a second tweet: ?I appreciate the driver. Man ran into traffic. Driver did the right thing & stayed & helped me & others aid man until medical help arrived.?

According to the New Jersey Star-Ledger, law enforcement authorities said a county detective was actually the first on the scene and rendered most of the aid.

?The detective immediately called 911 and began to render assistance,? said Katherine Carter, a spokeswoman for the Essex County Prosecutor?s office. ?He saw the victim was face down on the ground. He was bleeding from his mouth and nose. Det. [Michael] Davidson got some tissues from his trunk and began to wipe away the blood.?

Carter said Booker showed up ?within minutes,? followed by an ambulance and Newark police.

The Daytime Emmys showered "General Hospital" with five trophies, including best drama, while giving Regis Philbin a fond farewell as a departing talk-show host.

NBC's "Today" show won as best morning show and the syndicated "Jeopardy!" was named best game show at the annual ceremony Saturday.

"Live with Regis and Kelly" was saluted as best entertainment talk show (its first-ever nod in that category) and for best talk-show hosts. Philbin ended his long run as its co-host last November, with a replacement yet to be named to join Kelly Ripa as the syndicated series continues.

Heather Tom, who won as best lead actress for CBS' "The Bold and the Beautiful," made history as the first to win in that category after having previously won as both best younger actress and supporting actress.

Anthony Geary won as lead actor for "General Hospital." The ABC soap also won for supporting actress (Nancy Lee Grahn), supporting actor (Jonathan Jackson), and directing team.

The syndicated "Dr. Oz" was named best informative talk show.

Bill Geddie, longtime associate of Barbara Walters and executive producer of her ABC talk show "The View," received the life achievement award.

"There's not a lot of glamour and glory in daytime," Geddie told the room in his acceptance remarks. "But when you think about it, we're all here with the best of intentions: We just love making TV!"

Held in Beverly Hills, Calif., the 39th Annual Daytime Emmy Awards was telecast on the HLN channel, having moved to cable for the first time after airing on CBS the past two years. The awards are bestowed by the National Academy of Television Arts & Sciences.

The Beverly Hilton, where the presentation originated, was the site only hours earlier of what investigators believe was a murder-suicide. Police responding to a report of a shooting late Friday found a man and a woman dead from gunshot wounds in a guest room. The luxury hotel was also the site of Whitney Houston's death in February, when the singer drowned in the bathtub of her room.

Bad reports give Dow its second-worst day of year

The Dow started sinking after the Fed's Philadelphia branch reported a manufacturing slowdown resulting from a steep drop in companies' orders. It only got worse, as the index ultimately lost 250 points to close at 12,573, a 2 percent drop.

Relentlessly gloomy reports about the health of the world economy rocked?Wall?Street?on Thursday, stirring more worry about the stalled recovery and sending the stock market to its second-worst decline this year.

The bad economic reports kept piling up: Manufacturing slumped in China. A closely watched unemployment figure jumped to its highest level in nine months. Sales of previously owned homes fell. Then came word of a sharp contraction in Northeast manufacturing, the worst since last August.

Suddenly, the outlook turned so bad that a Goldman Sachs analyst told clients to place bets against the stock market.

"The news has been horrible out there," said Uri Landesman, president of Platinum Partners. "The U.S. economy is slowing down. And China's growth is definitely under question."

The Dow started sinking after the Philadelphia branch of the Federal Reserve reported a manufacturing slowdown resulting from a steep drop in companies' orders. Then the losses just accelerated.

Mining and other companies that made basic materials fell hard after prices for commodities such as copper and oil dropped.

Elsewhere, the Labor Department reported that the four-week average of applications for unemployment benefits jumped to the highest level since September. The National Association of Realtors also reported that sales of previously owned homes dropped 1.5 percent in May.

All this unfolded a day after the Federal Reserve slashed its estimates for U.S. economic growth and said it would extend a bond-buying program through the end of the year. The moves disappointed investors who had hoped for bolder steps from the central bank to get the economy going again.

"What's worse is that things are getting weaker without the Fed coming in," said Rex Macey, chief investment officer at Wilmington Trust Investment Advisors. "We had a run-up in the market this month because people had been expecting Fed action. Today, the market is giving it back."

The Dow lost 250.82 points to close at 12,573.57, a drop of 2 percent.

The Standard & Poor's 500 index lost 30.18 points to 1,325.51, a decline of 2.2 percent. The Nasdaq composite fell 71.36 points, 2.4 percent, to 2,859.09. All three indexes lost their gains for the week.

The report on slowing manufacturing in China was troubling since that country has helped drive global economic growth over the past four years. China is a major importer of copper and other basic materials.

A manufacturing survey for countries that use the European currency also showed a contraction. That report, together with the China slowdown, helped sink commodity prices. Copper and platinum fell 2 percent.

The only good news was apparently at the pump. The price of oil fell Thursday to its lowest level in almost nine months ? $78.20 a barrel. Gasoline was way down, too, at $3.47 a gallon, 46 cents below its peak in early April. Experts say it could dip to $3.30 by July 4th.

The Philadelphia Fed index pushed Treasury prices up and yields down as traders shifted money into their favorite hiding spots. The yield on the 10-year note slipped to 1.61 percent, down from 1.63 percent late Wednesday.

Material and energy companies, whose fortunes are closely tied to economic swings, led all 10 industry groups within the S&P 500 index lower. Just 12 of the 500 companies in the index rose.

In Europe, auditors calculated that Spain's troubled banks need as much as ?62 billion ($78.76 billion). A Bank of Spain official said that scenario was much less than the ?100 billion that the 17 countries in the euro currency union said they would provide for Spain's banking sector.

All day, speculation swirled that some major banks would have their credit ratings downgraded. After the market closed, Moody's Investors Service lowered the ratings of 15 the world's largest banks, including Bank of America, JPMorgan Chase and Goldman Sachs, saying their long-term prospects for profitability and growth were dimming.

However, with interest rates already at rock-bottom levels, the downgrades may not affect the cost of funding for the banks that much.

Among stocks making big moves:

? ConAgra Foods, a major food maker whose brands include Hebrew National and Chef Boyardee, gained 2.7 percent. The company's adjusted earnings and sales topped?Wall?Street's?expectations. The stock climbed 66 cents to $25.26.

? Bed Bath & Beyond plunged 17 percent, the most in the S&P 500. The retailer said it expects weaker earnings in the current quarter than analysts expected even though it reported better profits after the market closed Wednesday. Bed Bath & Beyond stock lost $12.50 to $61.17.

? Red Hat slumped 6.2 percent. The largest provider of the Linux open-source operating system for computers reported weak figures for deferred revenue. Red Hat's stock dropped $3.50 to $53.

Sports stars hail Baby Boks

Rugby

Rob Houwing, Sport24 chief writer

Cape Town - Twitter tributes to South Africa?s maiden triumph in the IRB Junior World Championship have piled in from beyond simply the rugby fraternity.

The Baby Boks deservedly beat traditional rivals New Zealand 22-16 in the showpiece before a record crowd of some 33 000 at Newlands on Friday - something that also earned some praise for this city.

Proteas cricket personalities got busy sending tweets, including coach Gary Kirsten (@Gary_Kirsten): ?Unbelievable effort! #Babyboks #Champions.?

Acting captain Hashim Amla (@amlahash) also gamely put the team?s embarrassing successive Twenty20 losses to Zimbabwe and Bangladesh on the back burner for a minute, saying from Harare: ?Well done babybokke! Putting a smile on the face of South Africans tonight. Enjoy.?

Sitting out that triangular but keeping his finger on the sporting pulse was normal SA limited-overs skipper AB de Villiers (@ABdeVilliers17): ?Proud to say the very least! Well done Baby Boks. #thefuture?

Similar sentiments came from top-ranked Test fast bowler Dale Steyn (@DaleSteyn62): ?Well done to our Baby Boks. Future looks good with these young men!?

Former SA bowling coach Vincent Barnes (@VincentBarnes50) was clearly proud of his home city?s staging of the final: ?Congrats to the Junior Boks on a great win. CT take a bow for putting up another great show.?

The feat did not escape the attention of the soccer community: FIFA referee Jerome Damon (@jerome_k_damon), who officiated at the 2010 World Cup, said: ?RSA are the champions of IRB U20 rugby! Tears of utter happiness! Give thanks to the Almighty boys! We are proud of you.?
T
here was also an avalanche of well-wishers, of course, from rugby circles.

Springbok lock sensation Eben Etzebeth (@EbenEtzebeth), preparing for Saturday?s third Test against England in Port Elizabeth, wrote:? ?Great, great, great! Well done Baby Boks. Now I can get over my disappointment of last year?s JWC!?

He was referring to the 2011 side, of which he was a member, ending a disappointing fifth then.

Now French-based Bok and former Bulls loosehead prop Gurthro Steenkamp (@gurthro) said: ?Well done to the Junior Boks! You guys made this country proud!?

Here is a selection of others:

Bryan Habana (@BryanHabana): ?A big up to Cape Town for packing out Newlands in support of our Baby Boks. #greatcitygreatpassion?

Flip van der Merwe (@flipvandermerwe): ?Great win for the Baby Boks, played awesome rugby! Jan Serfontein is a monster, many years of rugby ahead of him.?

JP Pietersen (@Jppietersen14): ?Congrats Baby Boks! That was amazing win, great stuff. Well done boys.?

Aljulah Cutts Sentenced To 25 Years To Life In Prison For Murder Of Felix Brinkmann, Holocaust Survivor

A Bronx man convicted of strangling a 90-year-old Holocaust survivor to death during a home invasion robbery was sentenced Wednesday to 25 years to life in prison.

Earlier this month, a jury found Aljulah Cutts, 30, guilty of murdering Felix Brinkmann in July 2009 in Brinkmann's Upper East Side apartment. During the attack, Brinkmann's eye socket was fractured and he suffered four broken ribs. He was found dead with a bed sheet tied around his neck and his mouth gagged with underwear, prosecutors said.

Two alleged accomplices to the crime, Cutts' brother, Hasib Cutts, 33, and Angela Murray, 33, will be tried for murder next month. Prosecutors said Brinkmann was bludgeoned and strangled after he refused to disclose the combination to a safe in his apartment.

Felix Brinkmann survived three World War II concentration camps, including Auschwitz, before immigrating to America in 1947, according to a recorded statement by his son, Rick Brinkman, which was played in court before Cutts' sentencing. Brinkmann co-founded the popular Upper East Side disco club Adam?s Apple in 1971, his son said.

?He beat the odds,? Brinkman, who spells his surname differently, said of his father.

In a statement to Judge Juan Merchan, assistant district attorney Shanda Strain called Cutts a "cold-hearted murderer."

"Felix Brinkmann was a kind, compassionate individual,? Strain said. ?He was a good person and he was taken -- taken by the defendant."

Cutts maintained he was innocent, and his attorneys said they intend to appeal the conviction.

"I try to stay as clean as I can throughout life," Cutts said. "I know I?m innocent."

Cutts confessed to the crime, but his defense attorneys said the confession was illegally obtained by police and should not have been shown to the jury.

Judge Merchan admonished Cutts from the bench before handing down his sentence.

"It was your plan to force Mr. Brinkmann to open the safe," Merchan said. ?But you did not know the strength and resolve of Felix Brinkmann."

Closing arguments set for Sandusky abuse trial

BELLEFONTE, Pa. (AP) ? Seven women and five men poised to hear closing arguments in Jerry Sandusky's child sexual abuse trial would begin jury deliberations without the benefit of having the former Penn State assistant football coach take the witness stand in his own defense.

More than a week of often-explicit testimony wrapped up Wednesday after Sandusky's defense team rested without calling their client. That set up closing arguments for Thursday morning, and jurors could start meeting behind closed doors that afternoon to start weighing Sandusky's fate.

Once famed for his coaching acumen, Sandusky is charged with 51 criminal counts for the alleged abuse of 10 boys over 15 years in hotels, at his home and in the football team's showers. Sandusky has maintained his innocence, and his attorneys have tried to weaken the prosecution's case by discrediting police investigators and suggesting that accusers are hoping to cash in on potential civil lawsuits.

Sandusky's arrest in November sparked an explosive scandal that led to the ousters of Hall of Fame coach Joe Paterno and the university president, and cast a critical eye on the role of college administrators in reporting abuse allegations. The sweeping case also led to renewed focus on child abuse issues.

The defense called just four new witnesses Wednesday, including a physician who they used to try to poke holes in the story of a Penn State assistant coach who testified that he saw Sandusky sexually assault a boy in the team showers more than a decade ago.

Defense attorneys finished in three days, resting around lunchtime Wednesday only after a longer-than-expected recess during which Sandusky and his lawyers huddled in private amid rampant speculation in the courtroom that he would take the witness stand.

Now, closing statements await the 12 jurors in a trial moving at a quick pace, more briskly than even the three-week time frame that Judge John Cleland had once estimated.

Cleland said he will begin Thursday by issuing jury instructions. The defense would then present its closing remarks before the prosecution takes its turn.

Then it's the jury that will determine the schedule depending on how long they take in deliberations. If convicted, the 68-year-old former defensive coordinator could be sent to state prison for the rest of his life.

Jurors will have to decide whether the defense was able to create sufficient doubt based on how the investigation was conducted, the reliability and motives of the accusers, and Sandusky's decades-long reputation as a man who worked tirelessly to help underprivileged children.

Prosecutors called 22 witnesses, including eight young men, ages 18 to 28, who alleged a range of abuse from grooming, kissing and massaging to fondling, oral sex and anal rape when they were boys.

Many of the 28 defense witnesses testified briefly to vouch for Sandusky's reputation. The defense's case has consisted of character witnesses who defended Sandusky's reputation, a psychologist who said Sandusky had a personality disorder and the ex-coach's wife, who said she did not see her husband do anything inappropriate with the accusers. His lawyers showed that an investigator had shared information with an accuser about other alleged victims' stories and repeatedly suggested that accusers have financial motivations for their claims.

Sandusky was only heard from via a November interview with NBC's Bob Costas, saying he probably shouldn't have showered with boys; and in letters he wrote to one of his accusers.

One of the last witnesses called was Dr. Jonathan Dranov, a physician summoned to the home of Mike McQueary's father in February 2001 to hear McQueary's account of seeing Sandusky sexually assaulting a boy in the campus showers. The boy, known only as Victim 2, has never been identified and isn't known to prosecutors.

Dranov testified that McQueary told of hearing "sexual sounds" and seeing a boy in the shower before an arm reached around to pull him out of view. McQueary said he made eye contact with the boy and Sandusky later emerged from the showers, Dranov said.

That account is different from what McQueary told a grand jury and testified to at a preliminary hearing and at the trial. He has said he saw Sandusky directly behind the boy's back, moving his midsection enough to convince McQueary it was a sex act.

Dranov told the jury that McQueary described hearing sounds he considered sexual in nature but did not provide him with a graphic description of what he saw.

"It just seemed to make him upset so I backed off that," Dranov said.

Asked to describe McQueary's demeanor, Dranov said: "His voice was trembling. His hands were shaking. He was visibly shaken," Dranov said.

McQueary's report to his superiors ? and Penn State officials' failure to go to outside law enforcement ? led to the firing of Paterno, who died of cancer in January.

McQueary had testified earlier in the trial that he wasn't "over-descriptive" in his conversation with Dranov, saying he told the doctor that what he saw was sexual, wrong and perverse.

David Hilton, who met Sandusky through a summer camp of his charity, testified Wednesday he felt like investigators were trying to coach him into accusing Sandusky.

"When it got to the second or third time I felt like they wanted me to say something that isn't true," he said.

During cross examination, lead prosecutor Joe McGettigan told Hilton that Hilton's uncle had contacted authorities out of concern after hearing of the initial charges against Sandusky.

Prosecutors allege that Sandusky met his alleged victims through The Second Mile charity. Sandusky founded the organization that once was lauded for its efforts to help at-risk children.

Sandusky didn't take the stand after his lawyer suggested in opening statements that he might and a day after his wife, Dottie, testified. In interviews Sandusky did shortly after his arrest in November, with the support and presence of defense attorney Joe Amendola, his responses were halting and uncertain, raising doubts about how he might stand up to cross-examination.

Criminal defendants in Pennsylvania, in serious crimes, generally are required to waive their right to testify on their own behalf, although that does not always happen in open court.

One of the jurors was excused from the case Wednesday with an illness; the female juror was replaced by an alternate, also a woman.

Sandusky attorney Karl Rominger also asked Cleland to dismiss five counts related to so-called Victim 8, the other boy never identified by investigators. Rominger argued that the timing of the charges had not been proven by the testimony of a janitor's co-worker, who said the janitor had told him he saw Sandusky molest the boy in a shower. The Penn State janitor himself was ruled not medically competent to testify.

The judge didn't immediately rule on the motion.

Nokia Lumia 610 with NFC handson

You never know what's going to be hiding in the deep dark corners of an event, and in our searches during the Windows Phone Developer Summit we came across the Nokia Lumia 610. But this isn't just the standard fare; no, this particular version offers NFC and should soon be making its way to Orange. Yes, by offering Near-Field Communication, the handset will be compatible with Nokia's NFC-enabled accessories like the Essence and Play360. While this elusive device is no stranger to us -- we've seen it shown on video, it's been certified for MasterCard's PayPass service and it's even been blessed by the FCC -- this was the first time we held it in our hands.

So what can we expect from this particular flavor of the Tango-running Lumia 610? Frankly, our impressions matched that of its non-NFC predecessor: build and overall feel remain unchanged from the original version. Naturally Nokia needed to find some space to stick the contacts and antenna, and those are inconspicuously found on the back of the device and on the battery cover, respectively. We still haven't seen any pricing surface, but it's been expected to arrive on Orange at the beginning of next quarter -- which frankly means we could well see it available within the next couple weeks, though we couldn't get an official date. Head below to get a good look at the NFC-enabled glory as well as a brief video showing the phone interacting with the Essence.

Are Twitter and Texting Ruining Public Speaking? - VerbaCom

I attended a real-time webinar the other day and as the presenter showed his PowerPoint? ?slides, he deviated from his presentation every 3-4 minutes to answer a question posed from the moving stream of webinar attendees that was displayed to the left of the screen. I couldn't help reading the attendees' conversations going on during the presentation, many of which had NOTHING to do with the topic at hand! I am easily distracted naturally and soon found myself more interested in what the participants were discussing amongst themselves than what the presenter was saying. I liken it to a crowd of people in a room having conversations while a presenter is trying to make a presentation in front of the room where no one is really paying attention.

Many attendees use their laptops during some one's presentation. My question is WHY? One could?say it is for note-taking purposes (did you forget how to write?) or emailing important information that simply can't wait until the talk is over (why don't you just exit the room and give up your seat to someone who indeed wants to be there and listen?) Some would even argue that it is now becoming more common to use the laptop to Tweet or text to friends who are not able to attend the talk, and give them your opinion of the presentation being?given in real time. Am I missing something here? Can't you guys wait until you see each other in a few minutes out in the hall, after the presentation or during a break or during lunch? Maybe I just don't get it. One thing I DO know: Good presenters spend many hours preparing a presentation for the benefit of the audience so that attendees walk away with the "nugget" of knowledge they came for. To be less than attentive by using electronic devices to Tweet or text continuously is, well,?rude and disrespectful to the presenter.

Frankly, I wouldn't recommend having an app where the screen displays the discussions during most live webinars and all presentations. Way too distracting. It?tends to?undermine the value of the presenter's knowledge and experience and his/her information being presented. Presenters?should be given the option to?either request that?all electronic devices be turned off prior to the presentation or, for the sake of the die-hard Tweeters, periodically make a slide in the presentation with a Tweet set in quotes summarizing a key point(s) and then give Tweeters a few moments to re-tweet it or copy it to text messages. Other options are to open it up for questions at the end of the talk or use an app that has the "raise hand" option that is monitored by an assistant who gives the questions to the presenter.

Don't get me wrong. Technology is great and we need it and should take advantage of it. I, myself, can't go anywhere without my iPad and smart phone.?Technology makes our lives easier and tasks more efficient, i.e., taking notes during a lecture, keeping up with the world events and information in an instant, anywhere, anytime. It does, however, have it's place.? When we humans want to really "connect" to one another, vis a vis, eye ball to eye ball, there really is?no substitute for truly listening, with no distractions, in?order to?learn and understand.? Maybe it's just me, but it seems that although we are more "connected" to one another than ever before through all our devices, somehow it also seems that we are becoming more isolated as humans as we communicate with each other through a flat screen and minimize the importance of communicating with a real live person.
